The Court has undergone some major changes since the Casey decision, and great hopes are vested in the addition of justices who understand that the judiciary is not to displace the legislature in determining the great questions of how a democratic society is to deliberate and decide the right ordering of our life together.
But the balance on the Court could hardly be more fragile. It ought not to be the case that, as is cynically said in law schools, all you need to know about constitutional law is how to count to five. In the unhappy circumstance of our culture wars, the proper goal is not to get the Court on one side or the other. The goal is for the Court to observe the self-denying ordinance of the Constitution and let the people, acting through their elected representatives, decide.
Senator Obama could hardly be more explicit in his hostility to that goal. Which is why Wednesday’s debate, for the first time in this campaign, made luminously clear the single most important question at stake in this election.

They say that [Barack Obama’s] economic and social policies would so diminish the demand for abortion that the overall number would actually go down-despite the federal subsidizing of abortion and the elimination of hundreds of pro-life laws. The way to save lots of unborn babies, they say, is to vote for the pro-abortion-oops! ”pro-choice”-candidate. They tell us not to worry that Obama opposes the Hyde Amendment, the Mexico City Policy (against funding abortion abroad), parental consent and notification laws, conscience protections, and the funding of alternatives to embryo-destructive research. They ask us to look past his support for Roe v. Wade, the Freedom of Choice Act, partial-birth abortion, and human cloning and embryo-killing. An Obama presidency, they insist, means less killing of the unborn.
This is delusional.

Lawyer and putative Catholic Dr. Nicholas Cafardi, a professor at Duquesne University, wrote an opinion piece attempting to justify his pr-Obama position in the ultra-liberal National “Catholic” Reporter. My response follows:
The Freedom of Choice Act, which Senator Obama has pledged to sign as his first act should he be elected president, removes ALL RESTRICTIONS on abortions that have been approved by the various states. Parental notification, partial-birth abortion bans, all of them, gone.
Dr. Cafardi rightly points out the new language in the Democrats’ platform about reducing poverty and other “causes” of abortion. But he ignores the leadoff paragraph in the platform’s section on “choice”, which is immediately above Cafardi’s reference, where the Democrats pledge themselves to oppose ALL RESTRICTIONS against abortion:
“The Democratic Party strong and unequivocally supports Roe v. Wade and a woman’s right to choose a safe and legal abortion, regardless of ability to pay, and we oppose any and all efforts to undermine or weaken that right.”
Democrats that adhere to their party’s platform are committing to abortion, no matter what twists of logic they employ to justify their vote. Catholic Democrats who are pinning their hopes on the new language about Obama reducing “causes” of abortion are being sold a lie. The vast majority of Obama’s supporters are equally convinced that he will not act in any way to prevent them from killing children. Want to take bets on who’s going to be right?
